Data as of: 2026-10-30, based on the Bureau of Labor Insurance’s official explanations of old-age benefits, labor pension contributions and occupational accident protection for re-employed workers. This applies to regular employees under the new labor pension system; self-employed people, workers who stayed only under the old system, and other special cases can’t be generalized.

This short got 280,000 plays on Facebook. The question matters most to two groups: older people who already draw Labor Insurance and went back to work, and people about to retire who worry that “once I claim, I can’t work.”

The conclusion in three sentences:

  • You can work. Going back to a job after claiming the Labor Insurance old-age benefit is legal.
  • You can’t rejoin Labor Insurance, and your coverage years stop growing. But your employer still has to cover you with occupational accident insurance.
  • The labor pension contribution continues. For employees under the new system, your employer still contributes at least 6% every month.

The point people mix up most is the last one: claiming Labor Insurance doesn’t mean your labor pension stops too.

First: what you need to claim the Labor Insurance old-age benefit

To claim, you must meet two conditions at the same time:

  1. Be eligible (age and coverage years)
  2. Leave your job and drop out of Labor Insurance

So “working and insured while drawing the Labor Insurance pension” isn’t allowed. But going back to work after you’ve claimed is a different story.

Back to work after claiming: three separate things

ItemRe-employed after claiming the old-age benefit
Labor InsuranceCan’t rejoin; coverage years don’t increase
Occupational accident insuranceEmployer must still enroll you (Labor Occupational Accident Insurance and Protection Act)
New labor pensionEmployer must still contribute at least 6% a month to your pension account

Labor Insurance: no rejoining

Once you’ve claimed the Labor Insurance old-age benefit, you can’t rejoin Labor Insurance when re-employed. Your coverage years stop on the day you dropped out. So if you’re going back to work to “add a few more years of Labor Insurance,” that won’t work.

Occupational accident insurance: mandatory

Since May 2022, occupational accident insurance has been separate from Labor Insurance. If you’ve claimed the old-age benefit and are employed again, your employer still has to enroll you. Accidents on the way to work or injuries on the job are covered by this.

Labor pension: a separate system, 6% continues

The labor pension is your own individual account, a different system from Labor Insurance. As long as you’re an employee under the new system, whether or not you’ve claimed Labor Insurance, your employer must contribute at least 6% a month.

Work 5 more years: how much does your employer save for you?

Assume a monthly contribution wage of NT$40,100 (roughly the 2026 median salary bracket):

  • Monthly: 40,100 × 6% = NT$2,406
  • Yearly: 2,406 × 12 = NT$28,872
  • 5 years: about NT$144,000, not counting labor pension fund returns

If you’ve already claimed your labor pension and keep working with contributions, you can apply one year after your last claim to withdraw these new contributions as a “continued contribution pension.”

If a family member keeps working after retirement, have them check two things

  1. Whether contributions are still going into their pension account. Use the Bureau of Labor Insurance online service or app to check the individual account and see recent employer contributions.
  2. Whether the employer has enrolled them in occupational accident insurance. Many people think “I’m retired and not on Labor Insurance,” so they assume they have no coverage at all. Occupational accident insurance is the employer’s legal duty.

I think the biggest value of this topic is letting older people who “go back to help out” know they still have rights — they aren’t working for nothing.
